O.I.G. (Office of the Inspector General) Exclusions

The OIG is normally informed about disciplinary actions by states then checks
on the reports. If they
verify the report and the action against the individual is short-term (e.g., a
few months), they likely
will not list the person on the exclusions list. If they have a felony related
to controlled substances,
they go on the exclusion list for 5 years. All persons being placed on the
list receive correspondence from
OIG explaining that they will be listed, how to appeal, and how to request
reinstatement. In some cases, it is
possible to request a permissive exclusion. This, or requests for
reinstatement following the defined exclusion
period, normally takes ~120 days (longer if investigations are necessary). An
individual may request removal
from the list beginning 90 days prior to the end of the defined exclusion
period;
there is a form that needs to be submitted. Removal from the list must be
requested; it is not automatic.

relate most to individuals disciplined for addictions:

MANDATORY EXCLUSIONS

Misdemeanor conviction relating to controlled substance. Minimum Period: 3
years
License revocation or suspension. Minimum Period: No less than the period
imposed by
the state licensing authority. |
