Walgreens sued for reckless disregard of public safety

In a trial to be held in the Circuit Court of Cook County, Ill.,
beginning Sept. 7, Walgreens is being sued for allegedly mislabeling
and misfilling a prescription that led to the death of a
patient,Leonard Kulisek. In the papers filed during the lawsuit,
Walgreens admitted that a pharmacy manager negligently misfilled the
prescription. The company also admitted that the pharmacy manager took
narcotics from its inventory "without permission and without payment."
Further, in charges that have not been denied by Walgreens, the
lawsuit alleges that the pharmacy manager named in the suit was using
the narcotics while on duty and that Walgreens' internal controls
failed to uncover the more than 80,000 narcotic pills taken from
Walgreens' inventory for a period of more than seven years. Walgreens
contends in a court-filed document that it adequately supervised and
monitored the pharmacy manager, however. The lawsuit, filed in January
of 2002, stated that Kulisek was filling a common prescription to
treat a case of gout but instead was given an antidiabetic insulin
substitute. The document further alleges that Kulisek's health
declined rapidly thereafter, as he developed acute renal failure,
which led to kidney dialysis and eventually a stroke and death. A
Walgreens' spokesman said the company cannot comment on pending
litigation but that it disputes the allegations issued by the
plaintiff's attorney.
